Terms of Service

1. Acceptance of terms

By accessing or using FlowTok ("Service", "we", "our", "us"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and FlowTok.

2. Description of service

FlowTok is a video scheduling tool that enables you to publish content to TikTok at a specified time using the official TikTok Content Posting API. FlowTok is an independent service and is not affiliated with, endorsed by, or in any way officially connected to TikTok, ByteDance Ltd., or any of their subsidiaries.

3. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction).
• You must have a valid TikTok account in good standing.
• You must have the legal authority to enter into this agreement.

By using FlowTok you represent and warrant that you meet all of the above requirements.

4. Account registration

You must sign in via Google OAuth to use the Service. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You agree to notify us immediately of any unauthorized access at flowtok@asytnyk.com.

5. Your content

You retain all intellectual property rights in the videos and captions you submit. By using FlowTok, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit your content solely for the purpose of delivering the Service.

You represent and warrant that your content:

• Does not infringe any intellectual property, privacy, or publicity rights of any third party.
• Complies with TikTok's Community Guidelines and Terms of Service.
• Is not unlawful, harmful, defamatory, obscene, or otherwise objectionable.
• Does not contain malware, viruses, or any malicious code.

6. TikTok authorization

By connecting your TikTok account, you authorize FlowTok to act on your behalf to publish content using only the permissions you explicitly grant. You may revoke this authorization at any time from the Accounts page or directly via TikTok's app settings. Revoking access does not automatically delete already-scheduled posts.

7. Prohibited use

You agree not to use FlowTok to:

• Upload, schedule, or publish content that violates any applicable law or third-party rights.
• Automate spam, coordinated inauthentic behavior, or platform manipulation.
• Circumvent or violate TikTok's platform rules, API terms, or rate limits.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Reverse-engineer, decompile, or create derivative works from the Service.
• Use the Service in any way that could damage, disable, or impair its operation.

Violation of these restrictions may result in immediate termination of your account.

8. Service availability and delivery

We strive to publish posts at the requested time, but we do not guarantee exact delivery times. Post delivery depends on TikTok's API availability, rate limits, network conditions, and your account status. FlowTok is not liable for missed, delayed, or failed publications due to circumstances outside our reasonable control, including TikTok API outages or changes.

9. Intellectual property

The FlowTok name, logo, software, and all related materials are the exclusive property of FlowTok and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary materials.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting us at flowtok@asytnyk.com.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLOWTOK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF $50 USD OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

13. Indemnification

You agree to indemnify, defend, and hold harmless FlowTok and its operators from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms or any third-party rights.

14. Governing law and disputes

These Terms are governed by applicable law. If you are located in the European Union, you may also benefit from mandatory consumer protection provisions of your country of residence. For disputes, we encourage you to first contact us at flowtok@asytnyk.com to seek an amicable resolution before pursuing formal proceedings.

15. EU consumer rights

If you are an EU consumer, you have the right to withdraw from any paid service within 14 days of purchase without giving any reason. You also retain all statutory rights granted by the law of your country of residence that cannot be excluded by contract.

16. Changes to terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service before they take effect.
